In consideration of my voluntary participation in the Acuity U education courses (the "Courses") provided by Acuity, a Mutual Insurance Company (the "Company"), I represent, covenant and agree as follows:

1. I acknowledge that the Courses provided by Company may qualify for continuing education ("CE") credits, and that Company may use the services of one or more third party vendors (each, a "Vendor") to submit CE credit reports regarding my completion of the Courses to the relevant insurance regulatory authorities.
2. I acknowledge that my participation in the Courses provided by Company is purely voluntary, and that I am not obligated to obtain CE credits through the Courses.
3. I do hereby for myself, heirs, executors and administrators, and other parties under or through me, fully waive all claims against Company for any losses, liabilities, costs, expenses or damages, including incidental, consequential or indirect damages, including, without limitation, damages for lost profits or business interruption arising out of Company's or a Vendor's failure to properly or timely submit my CE credits to the relevant regulatory authorities. I release and forever discharge Company from all such claims.
4. I agree to indemnify and hold Company harmless from all losses, liabilities, damages, costs or expenses (including but not limited to reasonable attorneys' fees and other litigation costs and expenses) incurred by Company as a result of any claims or suits that I (or anyone claiming by, under or through me) may bring against Company to recover any losses, liabilities, costs, expenses or damages which arise out of Company's or a Vendor's failure to properly or timely submit my CE credits to the relevant regulatory authorities.
5. I authorize Company to disclose to any Vendor engaged by Company to submit CE credit reports to the relevant regulatory authorities any such information that would facilitate the submission of CE credit reports, including, but not limited to, my name, agent state license number and National Producer Number (NPN). I further authorize any Vendor engaged by Company to share my completed CE credit compliance information with any agency with which I am employed and any insurance company that I represent.
